1. Merchant of Record

All purchases of OP-TIMIZER are processed by Polar Software, Inc. ("Polar"), who acts as the Merchant of Record. This means Polar is the legal seller of record for all transactions. Polar handles payment processing, tax collection (VAT, GST, sales tax), invoicing, and refunds. By completing a purchase, you enter into a transaction with Polar, subject to Polar's Terms of Service.

Andy Prinz Publishing is the developer and licensor of the software. These terms govern your use of the software after purchase.

2. License Grant

By purchasing OP-TIMIZER, you receive a personal, non-exclusive, non-transferable license to use the software on up to two (2) machines simultaneously. The license is tied to your license key and machine fingerprints. The license is perpetual (no expiration) as long as these terms are not violated.

5. Pricing, Payment & Delivery

The current price for OP-TIMIZER is CHF 29.- (subject to change). This is a one-time payment with no recurring charges. Applicable taxes (VAT, GST, sales tax) are calculated and collected by Polar at checkout based on your location and are displayed before you confirm payment.

Delivery: OP-TIMIZER is a digital product. Upon successful payment, you will immediately receive your license key and download links (Windows x64 and ARM64 installers) via email. Delivery is instant and fully digital — no physical goods are shipped. You can also access your license key and downloads at any time via polar.sh/purchases.

6. Right of Withdrawal (EU Customers)

Under EU consumer protection law, you generally have the right to withdraw from an online purchase within 14 days. However, for digital content that is delivered immediately upon purchase, the right of withdrawal does not apply once delivery has begun and you have acknowledged this. By completing your purchase and receiving your license key and download link, you expressly consent to immediate delivery and acknowledge that you thereby waive your right of withdrawal.

Notwithstanding the above, if you experience technical issues that prevent you from using the software, please contact us. We handle refund requests on a case-by-case basis through Polar. Refund requests can be submitted via [email protected].

7. Warranty & Conformity

Andy Prinz Publishing warrants that OP-TIMIZER will perform substantially as described on the product website at the time of purchase. The software is designed to modify Windows system settings to optimize performance and creates automatic restore points before applying changes.

For EU customers: Under EU law, digital content must conform to the contract for a period of two (2) years from delivery. If the software does not conform (i.e., it does not function as described), you are entitled to request that the issue be remedied. If the issue cannot be remedied within a reasonable time, you may be entitled to a price reduction or a refund. This does not cover issues caused by your system environment, third-party software, or modifications you have made.

Important: OP-TIMIZER modifies Windows system settings. Always create a full system backup before applying optimization or repair actions. The built-in restore point feature provides a safety net, but a full backup is strongly recommended. Andy Prinz Publishing is not liable for system damage, data loss, or other issues arising from applying optimizations without a prior backup.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Andy Prinz Publishing shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of this software. Our total liability shall not exceed the purchase price of the software (CHF 29.-). This limitation does not affect mandatory consumer rights under applicable law, including EU consumer protection regulations.

9. Intellectual Property

OP-TIMIZER and all associated logos, names, and designs are the property of Andy Prinz Publishing. All rights reserved. The purchase of a license does not transfer any intellectual property rights.

10. Termination

Your license may be terminated if you violate these terms. Upon termination, you must cease all use of the software and delete all copies. You may deactivate your license at any time via polar.sh/purchases.

11. Governing Law

These terms are governed by the laws of Switzerland. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in the Canton of Zurich, Switzerland. This choice of law does not deprive EU consumers of the protection afforded by mandatory provisions of the law of their country of residence.

12. Changes to Terms

We may update these terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the software constitutes acceptance of the updated terms.
